US Customs and Border Protection Terminates IEEPA Tariffs Following Supreme Court Ruling

According to a customer notice issued by Maersk, US Customs and Border Protection (CBP) has formally confirmed that duties imposed under the International Emergency Economic Powers Act (IEEPA) are no longer in effect as of February 24, 2026. The agency stated that IEEPA duties will not be assessed or collected on goods entered for consumption or withdrawn from warehouse for consumption on or after that date.
CBP announced that the IEEPA tariff provisions have been deactivated in its Automated Commercial Environment (ACE). Entry summaries for qualifying shipments will now reflect $0.00 in IEEPA duties. The agency clarified that the update applies only to IEEPA-based tariffs and does not impact other trade measures, including duties imposed under Section 301, Section 232, or other applicable programs.
The decision follows a ruling by the Supreme Court of the United States, which determined that IEEPA does not grant the president authority to impose tariffs. For goods entered prior to February 24, IEEPA duties remain valid under the regulations in place at the time of entry. CBP has not yet issued formal guidance regarding potential refunds or post-entry remedies for duties previously paid under IEEPA.
